Eversheds Sutherland - Legal Insights

Staying afloat and charting a course amidst the changing tides of privacy laws

11 Jun 2021

Description

The key to navigating the volatility and uncertainty in privacy and cybersecurity is to develop and main a proactive, agile and holistic data strategy – not just react when new court rulings, regulations or a data breach hit. Our privacy and cyber lawyers address the emerging US privacy regulations and how to achieve compliance across multiple US and global jurisdictions. Effective tips and strategies are discussed, including how to generate unified sets of policies, how to adopt revolutionary technologies like AI and biometrics, how to marry up employment law with privacy law, how to mitigate regulatory and class action risk, and how to balance enterprise needs and the rules governing the "sale" of data and the treatment of "sensitive" personal information. Specific US privacy laws addressed include: The California Privacy Rights Act (CPRA) passed in November 2020, which significantly amends the CCPA. When it goes into effect in 2023, the CPRA will further strengthen the rights of California residents and tighten regulations on use, retention and sharing of personal information. It also expands the private right of action and sets up a new enforcement agency, the California Privacy Protection Agency (CPPA). Recent passage of the Virginia Consumer Privacy Act. Other states where privacy laws are under consideration – Alabama, Arizona, Illinois, New Jersey, New York, and Oklahoma. In addition, this webinar examines key global privacy trends.
