Terms of Service

Please read these terms carefully before using Audioscrape

1. Agreement to Terms

By accessing and using Audioscrape ("Service"), operated by LionMint GmbH ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Audioscrape is a platform where users can create workspaces, contribute audio intelligence datasets, and collaborate on making the spoken web searchable. Our platform provides:

  • Workspace creation for audio dataset management
  • Tools for contributing and organizing audio transcriptions
  • Search and discovery across user-contributed datasets
  • AI-powered semantic search capabilities
  • Claude AI integration via Model Context Protocol (MCP)
  • API access for developers
  • Community collaboration features

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:

  • Maintaining the confidentiality of your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

You may not use another user's account without permission or create accounts through automated means.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Harass, abuse, or harm others
  • Distribute spam or malicious content
  • Attempt to gain unauthorized access to our systems
  • Scrape content without permission or exceed API rate limits
  • Use the service for any illegal or unauthorized purpose
  • Interfere with or disrupt the Service or servers

5. Platform Intellectual Property

The Audioscrape platform, including its code, design, features, and functionality, is owned by LionMint GmbH and protected by intellectual property laws.

User-Generated Content

Content within workspaces, including audio transcriptions and datasets, is created and contributed by users. You represent and warrant that:

  • You have the right to contribute any content you upload
  • Your contributions do not infringe any third-party rights
  • You comply with all applicable laws when creating datasets

Content License

By contributing content to public workspaces, you grant Audioscrape a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your contributions as part of the Service. You retain all ownership rights to your contributions.

Third-Party Content

Users are responsible for ensuring they have appropriate rights to process and share any third-party audio content. Audioscrape operates as a neutral platform and does not monitor or verify the copyright status of user contributions.

6. User Workspaces and Contributions

Workspace Creation

Users can create workspaces to organize and manage audio datasets. By creating a workspace, you agree to:

  • Take responsibility for all content within your workspace
  • Ensure compliance with copyright and intellectual property laws
  • Accurately set privacy settings (public/private)
  • Maintain appropriate attribution for content sources

Public Workspaces

When you make a workspace public:

  • Your contributions become visible to all platform users
  • You are identified as the contributor
  • Other users may search and access your datasets
  • You grant others the right to use your contributions under the license you specify

Indemnification

You agree to indemnify and hold harmless LionMint GmbH from any claims arising from content you contribute to the platform, including any copyright infringement claims.

7. DMCA Compliance and Copyright

Audioscrape respects intellectual property rights and expects users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to valid takedown requests.

Notice and Takedown Procedure

If you believe content on our platform infringes your copyright, please send a DMCA notice to:

Your notice must include:

  • Identification of the copyrighted work
  • Identification of the infringing material
  • Your contact information
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury
  • Your physical or electronic signature

Repeat Infringer Policy

Users who repeatedly infringe copyrights will have their accounts and access to the Service terminated.

8. API Usage

If you use our API, you agree to:

  • Use the API only for lawful purposes
  • Respect rate limits and usage quotas
  • Not use the API to compete with our Service
  • Include appropriate attribution when displaying our data
  • Keep your API credentials secure and confidential

9. Payment and Subscriptions

Certain features of the Service require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees as described in our pricing
  • Provide accurate and complete payment information
  • Authorize us to charge your payment method

Subscriptions automatically renew unless cancelled. You may cancel your subscription at any time through your account settings. Refunds are handled according to our refund policy.

10. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

11. Disclaimers and Limitations of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Results from the Service will be accurate or reliable
  • The quality of any content will meet your expectations

In no event shall LionMint GmbH be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

12. Indemnification

You agree to defend, indemnify, and hold harmless LionMint GmbH and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Request by law enforcement or court order
  • Extended periods of inactivity
  • Fraudulent or illegal activity
  • Non-payment of fees

Upon termination, your right to use the Service will cease immediately.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts of Frankfurt am Main, Germany.
