Yeah, so both of them are Venezuelans and 21 years old. Mayfred Duran Arape had been in detention for about 18 months, most of that time in El Paso, Texas. He does have a criminal record. While he was there, he was convicted of aggravated assault of a federal officer. The other person I talked to was Joyner Purroy Roldan.

He had been in detention for six months, and he does not have a criminal record besides illegal entry. He has been accused of being part of Tren de Aragua, which is a Venezuelan gang recently designated as a foreign terrorist organization by the Trump administration, but he says he has never been a member.

Okay, now both of them were detained in Guantanamo for about two weeks. Tell us more about what they're alleging happened there.

So both Duran Arape and Purroy Roland Tommy, the detainees at Guantanamo Bay, were not allowed to call an attorney. So they held a five-day hunger strike. At one point, they all blocked the cameras inside their cells so they could catch the guards' attention. And one of them, Duran Arape, also kicked on the cell's door as a protest. And he says soldiers showed up in riot gear.

He says they would beat him up and pin him to the ground. He alleges he was also tied to a chair 15 times and each time lasted a few hours. Things got so bad, Duran Arapez says he tried to die by suicide twice. And he provided us with photos of injuries to his arms, wrists and hands. Burroy Roland, the other man, alleges they did not have enough food.

And he says their cells were searched and they were frisked every time they left.

And what is the Trump administration saying about all these allegations?

So a spokesperson for the Department of Homeland Security tells NPR the agency cannot confirm the veracity of Duran Arapez's claims. She says that detainees have, quote, access to phone utilization to reach lawyers, but she didn't provide evidence.

White House Press Secretary Caroline Leavitt also responded to allegations made by some of the migrants detained in Guantanamo, saying the administration is targeting those who break the law.

But it's important to note that the Trump administration has admitted in court documents that nearly 30 percent of the detainees were considered, quote, low threat illegal aliens lacking a serious criminal record. The admission came as part of a lawsuit by the ACLU demanding migrants in Guantanamo get access to attorneys.

And just for some clarity, I mean, how is Guantanamo different from, say, a regular detention center?

I mean, these two men were held in a part of the base that was built for alleged terrorists post-9-11, and it's been described as a place without transparency. Munir Ahmed is a professor at Yale Law School and represented a Guantanamo prisoner for three years. He tells me Guantanamo is run by the military.

In an immigrant detention center, immigrants have access to attorneys and can video call their family members. That did not happen with the men detained in Guantanamo.

What do you know about who these people are or were? So the administration had said, Steve, everyone sent to Guantanamo were hardened criminals and that many were members of Tren Daragua, the Venezuelan gang. But now we know that's not true.

In court documents released because of a lawsuit by the ACLU, the Trump administration admitted that nearly 30% of the detainees were considered, quote, low-threat illegal aliens. Hmm. Many of the mothers of the detainees had been pushing back against that narrative. One of them is Joana RoldΓ‘n. Her son, Joiner Purroy RoldΓ‘n, had been accused of being a member of Tlendaragua.

I know my son has not committed a crime, she says, and he doesn't deserve to go through all of this just for trying to have a better future. And I should say, Steve, NPR didn't find any criminal record for Pujol Rolan, and it appears at least a third of the people with him in Guantanamo had not committed crimes.

What's the point? That's a good question. The administration knows that sending migrants to Guantanamo is very costly and very complicated logistically. But it's clear many of these migrants were used as part of a public relations operation by the White House. Most, if not all, of the people they sent to Guantanamo had already been in detention during the Biden administration.

So these were not new RSTs. And when they were put on a plane, there were cameras and those visuals were published across the world. It also tells us that Guantanamo will likely be a temporary detention facility that will be used to house migrants from countries where deportations might be more challenging.

Yeah, that lawsuit was filed by the ACLU because for a few weeks, no one knew where these migrants were. The family members had stopped hearing from their loved ones, and they assumed they had been transferred to Guantanamo, but the government never told them. And so the ACLU was alleging that the migrants did not have access to telephones to call attorneys or family members.

But despite this new development of removing people from Guantanamo, the ACLU says the lawsuit continues. Last night I talked with the lead ACLU attorney on this case. He told me the removal of all detainees won't stop the lawsuit unless the Trump administration tells the court they will not transfer anyone else to Guantanamo.

Good morning, Steve. What do you know about this flight? Well, the Trump administration announced yesterday that 177 Venezuelans who had been in Guantanamo Bay for a couple of weeks were removed to Honduras. That's all but one of the migrants who'd been detained there. Honduras was sort of a layover for them.

The Venezuelan government met them later and flew them back home, and the migrants landed in Venezuela last night around 10 p.m. local time.

wrote in his ruling that Trump's invocation of the Alien Enemies Act exceeds the scope of the statute. The government, he ruled, does not possess the lawful authority under the Alien Enemies Act to detain Venezuelan immigrants or remove them from the country.

The administration has accused all of them of being Trenderagua. But government officials have conceded not all of the Venezuelans have criminal records.

He concluded the ordinary meaning of invasion or predatory inclusion when the Alien Enemies Act was enacted in 1798 required a military incursion or a hostile takeover. He found that the criminal activities of Trenaragua members described in Trump's proclamation, while harmful, did not amount to an invasion or predatory incursion as understood under the act.

De Chodriguez wrote that Trump's proclamation does not suggest an armed group is trying to take over the U.S. So what does this mean for the men named in this lawsuit? Yeah, so the lawsuit names three Venezuelan men, but they're also representatives of a bigger class action. Here's the lead counsel for the men, the ACLU's Lee Gelernt.

And that's an important point here, Leila. This decision only applies to the Southern District of Texas, which includes Brownsville, McAllen, and Houston.

Well, the Department of Homeland Security did not respond to a request for comment, but it's almost guaranteed that the Trump administration will appeal this decision. The ACLU is certainly expecting that. If they do so, the appeal would go to the Fifth U.S. Circuit Court of Appeals, which is considered one of the country's most conservative courts.
