It is the defiance of the judicial branch, but it is as much Congress's failure to act in this situation, whether it's to step up and claw back some of these delegated authorities, to stop the national emergency that he's using for other things, or to take that final step and say this is a step too far.

It is a crime to deprive people of their rights under the Constitution or the laws of the United States under color of law. That's exactly what he was saying that he was going to do. We know that he can't be held criminally liable for that. Because he's doing these as official acts, and the Supreme Court has said that those are beyond the purview of Congress to criminalize.
