And that is giving her the benefit of the doubt.
She certainly treated him with less respect than one would a partner.
She was also simultaneously shooting another film while working on post-production.
Based on these factors and many more, the court found, as a matter of law, that no reasonable fact finder
could conclude that she was an employee.
She exercised far too much power for that.
Yeah.
And the other piece of this that's so crucial is she never signed the actor loan out agreement.
And if we remember, she held out signing it.
She had not signed this agreement by the time
they went to the press tour, right?
So when she's going to walk the red carpet for the premiere, up until that point, she's threatening to not promote the film if she doesn't get the poster design, if it's not her edit.
She uses this as, you know, a chess piece ultimately in order to get her way every step of the way.
Not signing the contract.
Not signing the contract, exactly.
But this has really come back to bite her essentially because what that did is it made her an independent contractor and not an employee, right?
And within that contract that she never signed, there would have been some sexual harassment protections.
So there was sexual harassment language in the ALA agreement, and her attorneys tried to cite that language in order to provide evidence for the case.
