What does subject to the jurisdiction thereof mean?
And I would argue strongly, along with a number of just sane lawyers out there, that it means you have to have established some legal domicile in the United States.
Put up the 14th Amendment.
There's a reason the 14th Amendment to the Constitution is pretty clear on this.
All persons born or naturalized in the U.S.
and subject to the jurisdiction thereof are citizens of the United States and the state wherein they reside.
Reside meaning a domicile, like you live there, not like you're an illegal invader.
If the authors of the 14th Amendment
did not, didn't want any exceptions.
In other words, you get here legally, illegally, have a child, child's a citizen no matter what.
Then why put and subject to the jurisdiction thereof in it?
Why not just say all persons born in the United States?
This, again, is the gift of Donald Trump.
Well, not actual time out, but time.
I didn't intend on going here, but I have to.
