Phil's saliva is on her drink glass as well as hers suggesting that they did kiss.

And it's also on her breast.

So there is some sexual contact that has occurred in some manner without a doubt.

Right.

Phil does not have blood splatter on himself, at least not in the suggested amount had he been in that situation.

Right.

Upstairs, the police find the white jacket that Phil was wearing when he was last seen at the House of Blues.

And although it has blood on it, the specs are tiny.
