Yeah, listen, officer-involved shootings have three key elements to them when they decide whether it's lawful.
The first is, did the person who was shot know that they were being stopped by law enforcement?
And that issue, we know for sure that's the case.
She was trying to block them with the car.
They had their lights on.
They identified themselves as ICE when they told her to get out of the car.
Secondly, they always look at what was she told to do.
Was she give a lawful instruction?
The instruction was to get out of the car.
She chose not to and drove forward.
The third thing is when an officer fires her gun, were they in danger?
That's the third element.
There is a singular piece of evidence that's going to be essential to this review.
And all the folks that I talked to in the last 24 hours who've investigated officer-involved shootings for decades of experience say that the most important piece of evidence is the bullet hole from the first shot fired by the ICE officer is directly in the front windshield.
What does that mean?
Why is that significant?
It means the officer had to be in front of the car as it was peeling away.
and he was in danger.
I think that when those three elements are reviewed, all of the politics are stripped away.
You have a person that was driving at an ICE agent after being lawfully instructed to stop and get out of the car.
