Attorneys for Rodriguez-Flores say ICE did not produce a warrant when they arrested their client, who claimed political asylum in the U.S., because she received death threats for reporting in Colombia.
She had been reporting on immigration enforcement efforts in Nashville and was arrested while driving in a car marked for a Spanish-language media outlet.
ICE officials say that they did have a warrant, although evidence of one submitted to the court was partially blank and missing her alien number.
The judge has set a Thursday deadline for ICE to submit written justification for the arrest.

After months of silence, Trump has endorsed Matt Van Epps, a former Tennessee commissioner and combat veteran.
Van Epps has also been endorsed by Mark Green, whose surprise resignation from Congress this summer kicked off the special election.
Outside money groups, including a PAC almost entirely funded by the parents of Amazon founder Jeff Bezos, have spent half a million dollars supporting his run.
More money from outside groups has gone to opposing anti-school voucher candidate and state representative Jody Barrett's bid for Congress.
Barrett and Van Epte will appear on a ballot of nearly a dozen Republican candidates in Tuesday's primary.
The general election is set for December 2nd.
