So, you know, the government tries to make it seem as though what sets the exceptions apart, what defines the exceptions, is that the government has some maximum theoretical power.
The government could have exercised plenary regulatory power over the tribes, and therefore that's the same situation as
a foreign national in the United States.

They're saying no negotiations are taking place.
They're calling the proposal excessive, unrealistic.
