The en banc panel issued the original opinion a couple months ago.

It sounds like they probably then stayed their opinion so New Mexico could appeal to, I'm sorry, not en banc, to just a three-judge panel.

They stayed their opinion so that New Mexico could appeal en banc, and the Tenth Circuit just a few days ago denied that appeal, sealing the ruling in.

It kind of is.

Colorado cannot reinforce its three-day ban in the 10th Circuit anymore.

At least that's that's how it should be.

And I'm not saying that's how it should be, because that's how it should be, man.

The way the courts have worked with this particular case, I think we're at that point is what I'm saying.

But I don't know for sure.

And nobody's ever been able to give me the answer on why not.

This is something I'd actually like to look into a little bit more.
