While the company had issued statements, Hum had issued statements to the ASX indicating it was considering the offer.
The takeover watchdog found this was misleading because Abercrombie had already rejected it.
According to a story in the AFR, Abercrombie as chairman and controlling shareholder had told the board the offer was of no interest to him shortly after receiving it in November.
It took another month for Hum to inform the ASX of the approach when the board said it was carefully evaluating it in the best interest of investors.
So that pressure has pushed Andrew Abercrombie out the door.
It's a bit of a miserable show today, isn't it?

For three months, multiple weather models have predicted a record-breaking El Nino.

So El Nino we're talking about, that would shift patterns of droughts, floods, heat, humidity and sea ice across the planet.
El Nino patterns are correlated with food shortages, impact on water supply.
In fact, some tropical countries are actually correlated with civil unrest because that's how important they are.
For Australia, models are suggesting the El Nino will result in a greater likelihood of droughts, certainly drier weather, but probably droughts, particularly later this year and into 2027.
Overall, much drier conditions are forecast today.
