Benny did not cooperate against anyone.
Benny pleads guilty, doesn't say a word to anyone, never cooperates, never is interviewed, and takes his lumps like a man.
So you got two defendants here.
Mario, who accepted a $7,000 bribe with allegations of other ones on the tape that were not observed or kind of monitored.
and goes to trial and loses as a city employee, Benny, who expedited many, many bribes but pled guilty to this one and then a conspiracy to have done others, says nothing and pleads guilty.
What sentences are you going to give Mario, the building inspector, and Benny, the expediter?
No criminal history on either man.
Is there a dollar loss associated with either one of them?
It's not a loss.
It's a weird kind of case, right?
Because it's a bribery to...
do a corrupt act of government.
So the bribe was $7,000, but I don't believe the sentencing guidelines, it doesn't really matter if the bribe is $7,000 or $70,000.
Perhaps the judge would take that into consideration, but I don't think the dollar, it's not like a fraud guidelines where you just plug in the dollar amount and spit something out.
This falls under a different guidelines range for acts of corruption and bribery.
