If there was an assault on stage, if someone had grabbed C1's face and thrown it to the side, why did no one from the cast ask C1 if she was okay?
It seems that no one on the night felt it necessary to check in with her.
Why did C1 not talk to any of her fellow cast members and tell them?
Rather, she told the director that Craig was angry.
How could the crew and stage management, let alone the cast, have not been aware of such an incident, if it were an actual assault?
Was it because in fact, as she testified, there was no element of force?
So let's go to the magistrate's final rulings.
Number 744.
C1 did not say she felt any pain associated with the application of force by the accused on this occasion.
It was not noticeable enough that everyone on stage saw it.
The application of force, though not momentary, was not sustained.
Number 746.
An element of the offence of common law assault is that the application of force must be intentional.
