进入“改革开放”时代后，随着“群众运动”的解体，“群众”转变为“市 民”。“市民”性质为“逐利的个体”，历史上也被称为“布尔乔亚”，以追求“排他性财产权”为其最根本的特征。基于这一社会现实，本文下篇通过辨析 作为最基本的“权利”的“财产权利”的双重内涵，即个体与集体之间的“最先 占有者的权利”内涵和个体与个体之间的“排他性财产权”内涵，探讨以“市 民”为基本要素，经由“最先占有者的权利”的充实而得到“个人权利”的完整 内涵，进而走出一条基于“个人权利”的“中国的民主化”的道路的可能性。
