All right, the Court of Appeal for the 6th Health District is now in session. Presiding Justice, the Honorable Barry Dre Greenwood, Associate Justice of the Honorable Allison M. Danner, and Associate Justice, the Honorable Charles E. Wood.
Please be seated. Good morning and welcome to the sixth district court of appeal for oral argument today. There are two cases on uh calendar this morning and we also have an afternoon calendar. After the first case there will be a um panel change. Uh before we get started with the first case, I do want to uh make just a couple of announcements related to technology. We are pleased to be able to provide remote appearances um to um folks who wish to uh appear remotely for argument. It appears this morning that everybody is appearing in person. Um but uh this afternoon there may also be remote appearances. We don't have a screen for those who are in the audience to be able to um see and hear what is happening, they can only hear it.
Um if you do want a visual experience, then um you can step outside and watch on our live stream. Um Uh and uh Also of note, um we archive all oral argument whether whether the attorneys and parties are appearing in person or if they are appearing remotely on our website almost immediately after oral arguments so they are accessible to the public. Right. Um Also in terms of technology, the um Um justices have access to our laptops up here on the Bench uh we have our notes, um the briefs, the record, everything that we need in order to. um engage in the oral argument and as a result, uh you might see us looking off to the right here or to the left. Um and um that's how we access the materials here. All right, to give me just a moment to get connected and we will be with you.

I'm going to have appellants counsel stand at the podium and state your appearance confirm your time estimate for us, please.
Good morning, Your Honors. G Kim appear on Bahler appointant uh appellant, Archon Design Solutions Inc. Um I estimate that the opening statement will be about ten minutes or a little bit less and I would like respectfully like to request uh to reserve five minutes for rebut.

Good morning, Your Honors. Gabriel Gregg for uh Respondent Global Semiconductor Alliance. Um I believe I'd reserved ten minutes. I'm frankly hopeful that I can do it in less than that. Oh, and we'll endeavor to.
All right, thank you very much. Um before we actually commence argument, uh I do want to simply remind uh both sides that um we struck the um the opposition, each party's opposition, uh to the motion for sanctions filed by each party. Um we are not considering sanctions at this time under California Rules of Court eight point two seven six C and D. We will not be entertaining argument regarding those motions this morning at oral argument. All right, thank you very much, Mr. Kim. You may proceed.
Thank you so much. May please the court. Again, good morning. G Kim for appelling Archon Design Solutions Inc. This is an appeal under code of civil procedure section nine oh four point one subsection A twelve. From a thirteen thousand four hundred monetary sanctions award arising out of a single discovery dispute. Respondus motion to quash or alternatively for a protective order concerning a third party deposition subpoena to doctor Walden C. Rhines. Arcon is not asking this court to relitigate every aspect of the protective order itself. The issue is the sanctions component. Whether the trial court could properly impose thirteen thousand four hundred dollars against Archon and its counsel on the record and under the governing statutes.
