Thank you. Uh we have one item for closed session. Uh city attorney, would you like to read that? Thank you, Mayor. Um with uh one item as you indicated, conference lif legal counsel regarding anticipated litigation, one potential case related to a claim filed by Deanna Santana. Thank you, Mayor. Thank you. Uh do we have any public comments on this? I see no one in the chambers. Do we have anyone online? No public comments. So we we will be um recusing ourselves to close session, convening to close session. We will be back here at five o'clock for the next open meeting. Thank you.
Good evening, everyone, and welcome to the Santa Clara City Council meeting. Uh the special meeting. I'd like to call this uh to order. Now we have before we start our regular meeting we have one item that we are going to discuss and it's item number two. Which is action on a resolution calling for a special municipal election and ordering consolidation with the Santa Clara County Presidential Primary Election on March 5th, 2024, for the purposes of submitting to the voters proposed charter amendments that would make the city clerk and the chief of police positions appointed by the city manager, as well as directing the city clerk to transmit. Submit the measures to the city attorney to prepare the impartial analysis and designating the parties responsible for the preparation of ballot arguments.
And I'd like to turn this over to Our assistant city manager Cynthia Borquez. Cynthia.
Good evening, Mayor and Council. Cynthia Horcas, Assistant City Manager. I am here tonight to speak to item number two on the agenda. And for the benefit of the public, I'd like to begin with a short background of the process that led us here tonight. On june sixth, two thousand twenty three, the city council approved the creation of the Charter Review Committee. Oh I'm sorry, mix yeah, there you go, thank you. On June sixth, twenty twenty twenty three, the City Council approved the creation of a Charter Review Committee for the purposes of soliciting community input. and making recommendations on what, if any, changes should be made to the city charter provisions that provide for an elected city clerk and or an elected city chief of police, including whether those positions should be appointed.
The council requested the Charter Review Committee provide a recommendation on whether co qualifications for the position should be changed. And if the positions were to be become appointed, whether the committee should would recommend that the city council or city manager be the appointing authority. On july eighteenth, twenty twenty three, the City Council made appointments to the committee, received a tentative meeting schedule, and established a budget to support the work of the committee. The meeting schedule provided for a city of a series of community meetings, followed by a presentation of the committee's work to the city council on November seventh, twenty twenty-three. And if if applicable action on November fourteenth, twenty twenty three, to consider potential ballot measures.
On November seventh, twenty twenty three, this count the committee presented the city council with an overview of its work. as well as a recommendation to hold a special election on march fifth, two thousand twenty four. For the purposes of considering two ballot questions that would amend the city charter to provide for the appointment of the positions of city clerk and the chief of police by the city manager. If the voters approved the ballot measures, it was also recommended that the city manager be encouraged to ensure as diverse an applicant pool as possible.
