Now, if I could turn your attention back to January 29th in the early morning when you were leaving the house on Thursday. You indicated that you saw a darker object in an area of the front lawn, is that correct? Yes. You had been to the house on 34th Avenue on several different occasions prior to this day, correct? Yes. Have you ever been over in that area of that front lawn?

Now, if you had realized or had recognized that dark object five or six feet long in that area near the flagpole, had you realized that was a body, what would you have done?

And your testimony again was that you put sort of two and two together the following day, correct?

Defending Karen made a guilty murder in the second degree, striking Mr. O'Keefe with her car, knocking him back onto the ground, striking his head on the ground, causing bleeding in his brain. swelling, and then leaving him there for several hours, in a blizzard, with temperatures in the teens, with winds swirling around, snow piling up on his body.

The defendant is the only one who sees Mr. O'Keefe, and yells and screams at Ms. Roberts to stop. Ms. Roberts and Ms. McCabe, I anticipate, will testify that they did not see Mr. O'Keefe, not only as they were driving past him, but even after they got out of the vehicle, until the defendant gets out of the back seat and makes a beeline, essentially, right over to where Mr. O'Keefe's body was found.

As far as the one that you observe screaming or crying, do you recall specifically what, if anything, that person said? All I recall her saying was, is he alive?
KAREN: THE RETRIAL

Trooper Paul didn't seem to understand what he was applying. He noted that he had 120 hours of study. And when he was asked questions, he just really struggled. His explanations were things like, well, that's just how it happened. He was forced to amend his sort of version of how things happened to move John O'Keefe, his sort of initial starting point, another 10 feet.

And the problem is that this gets us to what ends up being a very implausible vision of how this vehicle collision happens, because, of course, they're not alleging that it's an accident.

Their theory is that the vehicle hits sort of just his arm, breaks the plastic, the polycarbonate there, and then somehow from that throws him quite a substantial distance to hit his head and ultimately come to a rest some 30 feet away. When you just picture that in your head, it looks ridiculous. It looks on its face to be sort of cartoonish.

So I found that to be striking because he is critical to the prosecution's case. This is their whole theory of what happened. And he's the linchpin of it.

And he's a critical witness because they're trying to explain that this is a motor vehicle impact with a pedestrian, and they're trying to provide a coherent explanation for how that happened.
