The father actually has no rights to the children unless he goes to the courts
Proof's paternity then seeks a custody order.
So according to officers, there was nothing they could do.
The children were known to be with their mother, who has custody.
There were no court orders saying otherwise, so there was no reason to think that either of the children were in any danger.
But that wasn't necessarily true.
Just months before Madison and her boyfriend took off with the children on October 26, 2022, officers responded to a call regarding domestic abuse at the hands of Roan Waters.
In the report, Madison said that Roan had hit both her and her then one-year-old daughter Oakley in the face.
When officers responded to the residents, they were met with Roan at the front door.
He asked them if they had a warrant to be on the property, but before the officers could answer, he slammed the door in their faces.
The officers tried talking to Roan through the closed door to explain why they were there, but Roan just told them to get the F out.
As they started heading back towards their cars, they saw Madison pull up in her truck with her two children with her.
Officer started speaking with Madison, which Roan noticed, so he stepped outside the home, started yelling, then started blasting music so that he could prevent them from talking.
As all of that was happening, officers were trying to ensure Madison's safety until she eventually told them that they could leave.
She was just fine.
Later that same day though, Zach also called the police to inform them that he was now with Madison and their two children, so she was ready to make her official report.
At that time, Madison explained to officers that Roan had smacked Oakley in the face with an open hand to get her to stop crying.
This caused Oakley to sustain a gash on her upper lip, which officers were able to see.
Madison said that she confronted Roan about smacking her daughter, but that just led him to smacking her across the face.
Officers noted bruising and contusions on Madison's left eye and cheek.
