The magistrate ignored Craig's evidence, the archival video, and indeed the evidence of C1, who stated under oath that the scene played out exactly the same, at least from the audience's perspective, every night.
There was no moment in the scene that her hands were required to be on the top of the bed sheet, her back was facing Craig in the first moment he disappeared...
But more to the point, what of C1's evidence regarding the moment where the alleged assault occurred, that being the second time Craig ducks out of view?
Why wasn't this included?
Well, on the final day of the matter, I was in court when a most extraordinary thing happened.
The prosecutor, in his final summations, challenged Craig and his barrister about the chosen moment C1 claimed the touch occurred.
As you recall, it was determined that it was the second time Craig disappeared from view and that this was a five to seven second period towards the end of the scene.
The prosecutor then stated that C1 did not concede that that was where the alleged assault occurred, that she had been asked where it occurred but she couldn't recall precisely and that because Mr Littlemore pushed her for an answer meant that this evidence shouldn't be accepted.
Therefore, it was not C1's evidence that the assault occurred at that point.
When the magistrate responded with words to the effect of
And then she was pressed in terms of your best guess or your best answer.
Mr Littlemore replied that he most certainly didn't invite C1 to guess, but to do her best.
It was then Mr Littlemore QC pulled the big guns out.
He said that the prosecutor had fudged the evidence in his submissions about C1 nominating that point at which he claimed to have been indecently touched.
He then invited the magistrate to look at transcripts from November 26, 2019, where with laser focus he read out the following.
A robust argument was then put forward by Mr Littlemore that it's simply not right to pretend that evidence can't be relied upon, particularly because C1 under oath swore that the video was typical of the way the scene was played on every occasion in 2014.
that there was only one part of the scene where she faced Craig and that is the moment when she is operating the artificial leg, although they are at opposite ends of the set.
