The Trump administration is suing Colorado for providing in-state tuition to non-U.S.
citizens. The Justice Department is challenging Colorado statutes that require state colleges and universities to provide in-state tuition rates, financial assistance, and scholarships to those who are Colorado residents regardless of whether they are in the U.S. illegally. The DOJ alleges the laws unconstitutionally discriminate against U.S. citizens who are not afforded the same reduced tuition rates or scholarships and create incentives for illegal immigration. The department says this is its 14th lawsuit challenging in-state tuition available to non-U.S. citizens after bringing cases against states including California, Maryland, and New Jersey.
