Chapter 2: How is the FACE Act being applied in current protests?

During the Biden administration, we all became very familiar with the Freedom of Access to Clinic Entrances Act, otherwise known as the FACE Act. This was the Clinton era law that had been mostly dormant for the past two decades. Then Merrick Garland took over the OJ and the FACE Act was used to prosecute dozens of Christians who demonstrated in front of abortion clinics.

And in some cases, as you remember, as we talked about it on the show, pro-life demonstrators woke up to SWAT teams outside their homes. Meanwhile, the DOJ ignored the violent attacks on pro-life pregnancy centers. And this was just a ruthless series of prosecutions that targeted Christians, including elderly women in their 80s, and threatened them with 10 years in federal prison or more.

But there's another element of the FACE Act that never gets mentioned. Because as it turns out, strangely enough, the FACE Act doesn't only protect abortion clinics. The law also makes it a federal crime to obstruct or interfere with anyone, quote, lawfully exercising or seeking to exercise the First Amendment right of religious freedom at a place of religious worship.

So, yes, the same law that bans protests at abortion clinics also bans blockades of churches. which seems a little strange. What are the two things have to do with one another? How can I talk to them?

Really, so I guess, you know, protesting is all about making people uncomfortable. It's about disrupting. And Don Lemon says there's nothing in the Constitution that stipulates, you know, where or when protests are allowed to occur.

I mean, he just made the argument for it.
