Burnley FC have won a massive legal compensation case against Everton over Everton's breach of Premier League profit and sustainability rules, otherwise known as PSR, formerly known as FFP. No doubt we'll have another acronym afterwards. So the background to this is in the 21-22 Premier League season, Everton breached PSR. by overspending by 19.5 million, right, over the 105 million limit over the three years. This led to a 10-point deduction, which was later, if you remember, reduced. But it came too late to affect that season's relegation battle. Burnley were relegated, finishing 18th or just below safety, depending on the exact standings, just four points behind 17th place.
Burnley claim that they argue that Everton's breach gave them an unfair sporting advantage, costing Burnley their Premier League status and associated revenues. That's TV money, etc. They sought damages reportedly around 60 million pounds initially. The case was heard by an independent tribunal of resolution in London. So it's taken quite a while to get here. And the outcome today is that Burnley won the dispute. And Everton have been ordered to pay Burnley nearly 40 million pounds. Not not an insubstantial sum, including compensation and interest. Obviously, Everton plan to appeal. But this is a landmark case. And the first successful PR related compensation claim. Where will this end? can of worms lead to.
The latest news I think I just saw, let's have a look, is Everton have launched an appeal after being ordered to pay Burnley the £35-40 million in compensation. The Toffees were deducted the 10 points as we know in 2023. Everton officials have lodged an immediate appeal in what they class as a completely flawed judgment. Obviously, they're going to say that because they're being forced to pay out the money. They say they will vigorously contest what they see as flawed and a hugely excessive judgment. Bearing in mind that Everton's lawyers were successful in reducing the 10 points, will they be successful again here? I personally think that a lot of clubs in the league will potentially join forces to help Everton here because could you imagine if this actual case stands its ground?
Because what's going to happen here is that you're opening a can of worms. What's going to happen if Manchester City get relegated going back all those years? Could you imagine how many clubs... Think about it. How many clubs have been relegated, missed out on Champions League because the Premier League actively knew exactly that they were breaking the rules.
