Um before we get started with the calendar, um I have a brief announcement to make and um a few related comments and uh maybe joined by my colleagues. Today's the last day that Justice Miller is gonna hear oral argument as a member of this division and our court. Um, we might try to suck her back to be a pro tem someday, but uh she's made no commitments. Um, she's retiring in a few weeks. And so it's bittersweet and you know Джастис Моерс кареє хан форті сір. And uh She served on this court for twelve, but on the um superior court as well for nine of those. And when you count her stint in the US attorney's office and with the DA's office. She's worked well over half of her career in public service and

And um you know, speaking as a colleague of hers, I can say that she's contributed a huge amount to this court. Um every case she's presided over, she gives it sort of incredible full attention and uh makes sure that the rest of us don't make any mistakes. Um and until she's got her mind completely wrapped around the case and she's convinced of what the right application of the law is, she doesn't let up. She's sort of like a dog with a bone, but she's much prettier. Um, in a word, she's indefatigable, some might say relentless. Um We we tease each other a bit here and there. Um, well, you know, her her career in public service is all the more remarkable when you consider that she graduated with a BA umeta kappa from Harvard and then went on to graduate with a J D cum laud from Harvard.

She could have Um, done anything she chose as a career and she could have gone about making a lot of money. She was born in Southern California and was a movie buff, and she might have chosen to represent the rich and famous um and devoted her career to to being famous herself for that and and to making bundles of money. But And I will point out parenthetically that um she did very early in her career represent the state of California in a dispute over taxation of the Howard Hughes estate. But I think that was the closest she got to a real Hollywood case. She can correct me if I'm wrong. Um, you know, that she chose to do public service for all those years, um, as opposed to um More lucrative things.

and and business related things. It just reflects who Justice Miller is and how deeply she cares about fairness, about human beings and about the rule of law and our constitutional democracy. Um and I've been really honored to get to serve alongside her. All along the way she's given more of herself to each position than it required of her. A really notable um piece of that is that she was a member of for the uh uh as a barrister, but then continued later on um on the McFetridge in a court, which is something where you m mentor younger lawyers and even somewhat more experienced lawyers. And she did that um all through her years on the bench, in addition to being a member when she started out. early in her own career.

Um and y that that's a lot of hours and she actually served as president of that and of course. Th there's um a couple more I wanna mention that she did on this court, um, but the her contributions to our system of justice are too many to mention. But one is that she has been involved in ethical judicial ethics issues and she's deeply knowledgeable about it. Um I always run down and ask her if I'm questioning whether I'm close to the line. Um but she taught legal ethics. It's a Challenging topic and one but it's super important for making sure that judges act in an impartial and fair way. Um she's also um You know, d been involved in a Supreme Court committee on judicial ethics opinions and written opinions.

These are extra jobs. These are way above and beyond. Um there's more examples, but I as I said there's too many. But what I can say is that her Justice Miller's participation in the work of the courts has made our branch stronger.
