Okay, why don't we stop the clock for a moment in order for um Well, Miss Silver, you're leaving.
Terry L. Jackson 3:26
Okay. Well, um Miss Roden, the appellant has left voluntarily. Uh I don't leave um Justice Burns, do you have any questions you wish to ask? No. Justice Chu? No. I don't have any questions I wish to ask of you, so you do you want to just submit it on the papers?

Okay. I it's been indicated to me by the clerk that um the appellant is not here. She voluntarily left. Miss Roden, you do understand you received a tentative from the court.
Ellen Roden 5:17
I understand that.
Terry L. Jackson 5:19
Okay. So I
Ellen Roden 5:20
want to address the tentative if I may.
Terry L. Jackson 5:23
All right. You're welcome to.
Ellen Roden 5:26
Um I with with thank you, with leave of the court. See the issue I wanted to address is that of course I agree with the court's a tentative decision on the a tentative opinion on the liability. Can everybody hear me? Yes. But um what I wanted to address is that the court the superior court, after rather an exhausting three hour evidentiary hearing, failed to rule on the question of my damages, which was presented in my petition and they're somewhat substantial. And therefore I would like to and I ad acknowledge that it was I a I requested it in my reply brief, that the court addressed that in my reply brief. but it was only in the conclusion and not under a separate heading and I I I acknowledge that.
Ellen Roden 6:23
And I want to explicitly clarify That if the court finds any procedural defect in the judgment, I would like to ask for a limited remand solely for the calculation and award of my damages, which is what I requested in the conclusion of my reply brief.
Ellen Roden 6:52
Direct the proper judgment or further proceedings, as I'm sure this court knows under CCP section 43 and CCP section 906, and again under section CCP
