This is the time set for the Telephonic Procedural Conference for docket number RR02635B 260306 in the matter of the application of BNSF Railway Company. All right, thank you. Um, so as stated in the August nineteenth, twenty twenty six procedural order, the purpose of today's conference is to establish uh the procedural schedule in this matter. Uh so I do want to start with asking the parties whether they had a chance to discuss one. Um, and I'll I'll go ahead and start with BNSF, but we can kind of Make it mm use a a discussion format.
Uh yes, Your Honor, I think at this point we are waiting for a meeting Between the parties. See if any progress might be able to be made on Yeah, okay. Any any further kind of discussions, agreements, alternatives, um, Mr. Bodkin has been spearheading that effort. And I believe that meeting is scheduled for September twenty first. Um, to get all the parties. But maybe not the attorneys. in a room and and see what what can't be accomplished there.

So I I do not believe the parties have discussed Scheduling. Other than Kind of this. This meeting. El If we can address any of the issues. Of the county um Or see what can't be kind of ironed out, maybe. case moving forward. But Your Honor.

I I was I just wanted to clarify with Sean since he set up the meeting, but I do believe the attorneys are expected to attend and if you could clarify that when he starts to speak, that would be really helpful.

Thank you, Your Honor. Um yes, this this is a meeting to basically discuss the application and the outstanding face the issues that staff has identified with all the parties and their their their attor their attorneys are also, you know, welcome and expected to attend. Um This meeting is basically the as Mr. Los Santos mentioned to Hopefully work through any unresolved concerns that the parties have. So that when this does come to hearing, we can staff can present a staff report that is supported by all the parties. That that is our goal.

Well first I'll ask if that's correct and then second if That is something that the parties would like to discuss either today or at that September twenty first uh meeting. Um and I'll start with staff and then and then we can go from there.
Your Honor, in in staff's opinion, uh that is one thing we would like to discuss after we have Monday's meeting. I think the the results of Monday's meeting will have a distinct influence on the procedural schedule discussion on on where the parties go next. depending on the resolution of the issues or a a a lack of agreement on the issues. So I I would prefer if the other parties agree that we wait to hammer out any procedural details until we have a better idea of of what the outstanding issues may be.
Okay. Um so then I'll go to Miss Weber and see uh if You would prefer to discuss that the procedural schedule at that September twenty first meeting?
