All right. We can start just now. So people who are listening may want to be started on time. So I'm David McGettigan. I'm deputy planning director. We have several speakers here. Raj Badari is going to start us off to talking about this proposed design and construction standards manual amendment.

Hello, Raj.
My name is Raj Vidari. I'm with the Department of Public Works, Environmental Management Division. I'm here to present to you on the updates to the Design and Construction Standards Manual. I can go with the background on why we are here to update these regulations. The consolidated bill chapter 758 and 68 of the 2016 acts of assembly provided foundation are directed the State Water Control Board to merge Virginia stormwater and erosion control regulations into one program. And they also requested that it needs to have an effective date with it. With that, the Virginia State Water Control Board adopted the final Virginia erosion and stormwater management regulation on June 22, 2020. with an effective date of July 1st of 2024.
And also they issued a model ordinance December 27th, 2023 for local implementation. With that... BO's Board of County Supervisors approved resolution number 24-255 on March 19th, 2024, initiating the local implementation process for updating the design and construction standards manual. So with that initiation, we had our first draft of DCSM and the VSMP ordinance distributed to DORAC on February 5th of 2025. First DORAC meeting was held on February 25th and we received feedback as well as discussed any of their concern. And the second draft of the DCSM with comment responses were sent on March 17th, 2025. The second DORAC meeting was held on April 24th, 2025, and no new comments were received. However, the county announced that there were two things which we were trying to make some adjustments.
One was the wetland permit timing change. We are changing the requirement of permit for any wetland disturbance presented or evidence presented to the county at the time of obtaining the land disturbance permit rather than the plan approval. So it can give them some time ahead to go ahead and record their plat and whatever the advanced thing they can do. So it will benefit the developers. And also we informed them that we are going to the Planning Commission on May 28th. And we also participated with the NVBIA meeting on April 30th and addressed any questions and concerns they had. So with that being said, Pursuant to this, as stated earlier, the legislative directive of 2016 amended the State Water Control Board to adopt consolidation to our single regulation addressing both erosion and stormwater runoff.
State Water Control Board action, which was on June 22nd of 2023, consolidated three existing chapters, which is the erosion and sediment control regulations, and erosion and sediment control and stormwater certification regulations, and Virginia stormwater management regulations into a single chapter called Virginia Erosion and Storm Water Management Regulation, which is the VESM regulation. The VESM regulation became effective as of July 1st of 2024. The new regulation clarifies program requirements, eliminates redundancies, and corrects inconsistencies between erosion and sediment control and stormwater management regulations.
No substantive changes were made to the requirements. The VESM regulation does not alter compliance obligations or requirements such as plan submission, obtaining the permit, ongoing compliance with erosion and stormwater regulations. These requirements still apply to regulated land disturbance activities. Technical, no technical changes were made to the erosion and sediment control minimum standards or the post-construction stormwater management criteria. So technically there is no change in preparation or the requirement for the ENS and stormwater management plan preparation and submittal and the review process.
