I want to provide one caveat.

And I also think it's important to keep in mind that there is a lot of disagreement amongst lawyers.

We are in a legal uncertainty right now because there is no binding case law that interprets any of the provisions that we're trying to apply.

So I am going to be focusing my presentation based on the plain language of the statute as opposed to how it may be interpreted by a court if challenged, okay?

So the first slide is

I'm talking about the Housing Accountability Act.

It's found in Government Code Section 66589.5, and I put that up there because I think a lot of people say SB 330, and they talk about all of the Senate bills that enacted all of these laws, but really what we're talking about is a Government Code Section.

And in that Government Code Section, there are many, many provisions in the Housing Accountability Act.

But what's important to note is the stated intent of the Housing Accountability Act.

The stated intent is to significantly increase the approval and construction of new housing for all economic segments of California's communities by meaningfully and effectively curbing the capability of local governments to deny or reduce density

for or render infeasible housing developments.

So that's a big deal, right?

Clearly the state legislature has spoken and they wanna see, they wanna facilitate the development of housing.

It's also important to note the interpretation and implementation of the Housing Accountability Act and it's going to be the policy of the state that it be interpreted and implemented in a manner to afford the fullest possible weight to the interest of an approval of the provisions of housing.
