Eventually some sort of deal was reached with Virgin where future beef art recordings would still be released on their label in the UK.
Unfortunately, the next album was messed up in other ways.
Batchain Puller was recorded for Zappa and Cohen's discrete label in the US and for Virgin in the UK, and everyone involved agreed it was Beefheart's best since Clear Spot, if not since Trauma's Replica.
Unfortunately, the album got caught up in litigation between Zappa and Cohen.
Zappa had fired Cohen and Cohen's lawyer brother Mutt, accusing them of embezzling money from him.
And one of the prime examples he used in the lawsuit was Batchain Pull of itself.
By Zappa's account, which from what else I know of Cohen appears to be true, Cohen, as co owner of Discrete, had used some of Zappa's money to pay for the recording costs of Batchain Puller.
Cohen was insisting that any royalties from the album would need to go to him as co owner of Discrete and as Beefheart's manager, while Zappa was saying he needed to make his own money back.
Zappa had physical ownership of the tapes, but they couldn't be released because Cohen would sue if they were put out.
This was also the point at which Zappa had to stop calling his bands the mothers of invention, as Cohen claimed to own that band name.
From that point on, Zappa's band would just be known as Zappa.
And to make matters worse, Virgin had distributed some promo tapes of rough mixes of the album to wet people's appetite, and now the entire album was being bootlegged.
There hadn't been a new Captain Beefart album in years, and now all the people who would have bought this one, his best of the seventies, had already got their bootleg copies.
Batchain Pulla was finally issued legitimately in twenty eleven, a year after Befart's death and eighteen after Zappa's, by the Zappa Family Trust.
Around the same time they reissued Tram Mask Replica and trademarked the Beefart name.
Like Tram Mask Replica, it is currently out of print and not legally available to stream.
The legal problems around the album caused the final break between Zappa and Beefheart, although the two apparently reconciled shortly before Zappa's death in nineteen ninety three.
They also mark the end of any career momentum for Beefheart.
Two years later, yet another magic band lineup, featuring Tepper and Fowler plus a collection of much younger musicians who had grown up listening to beef art music, recorded a new album, Shiny Beast Batchain Puller, consisting partially of re recordings of Batchain Puller tracks, plus new ones.
Two years after that came Doc at the radar station, with John French returning for the last time, mostly on guitar, though also adding some marimbas and drums.
