The first question, yeah, based off of everything I've read, absolutely the NFL can violate the CBA by unfairly restricting the employment opportunity of someone who is not yet in the NFL.

Jeffrey Kessler actually argued this and lost in the Maurice Claret case a number of years ago when Claret wanted to declare for the draft after his freshman season at Ohio State.
