If the person who caused someone to die was drunk and did it not out of consciousness but out of uh you know, lack of consciousness, then they pay a lesser price.
Whereas the person who comes along with the the intent to harm in a conscious way, which is never really conscious, but it could be more conscious, more sinister, more psychopathic or whatever, which you couldn't be more unconscious at that level.
Um then they are considered to be more responsible.
