It's fundamentally unfair for him to be defending both of these cases on a parallel track.
And what this now has done is really revive that double jeopardy argument.
The defense wasted no time in filing a motion to dismiss in the state case, arguing that these prosecutions violate his constitutional right in the Fifth Amendment and his right not to be charged twice for the same.
Same offense.
Also, there's, we know there's a really robust state, New York State doctrine of double jeopardy, and they're essentially arguing that, you know, this is not fair.
So they're arguing that he's, quote, a pawn in parallel prosecutions.
They're saying these two sovereigns, both the federal prosecutor's office and the Manhattan District Attorney's Office, are essentially coordinating and acting as one.
They're saying he committed one crime.
One crime only.
He possessed one gun and he fired a single, he fired shots at a single person.
The conduct that he is being charged for in both of these uh trials is the underlying conduct is the same, even though they are different, perhaps, you know, statutory crimes.
And so, you know, that's not a frivolous argument to make, Katrina.
I mean, a lot of legal analysts are waiting.
Weighing in on this issue.
I personally don't think it's necessarily a winning argument, but it's not a frivolous argument.
It it has some merit.
And certainly I think that the judge in the state case will want to give this a really fulsome um, you know, reading and and think about how they're going to move forward with this state case.
I mean, it just, it just has to potentially delay this trial.
I mean, I don't see
this trial moving forward as it's scheduled now for September.
