I think that the punishment is absolutely too severe. voice-verified

And we have seen in many cases that this is consistent with what we know around sentencing data in America, where you have an alleged black perpetrator who is a male and a white male victim. voice-verified

Those sentences are usually disproportionately higher than any other race combination that you've seen. voice-verified

And so in some ways this tracks with the data, but if you're looking at the totality of violent crimes and how they are sentenced, this is way beyond what you would normally find, particularly for an offense where the motive could not be, well, the intent could not be established to be, for example, something that was premeditated, something that was sort of preplanned, those sorts of offenses, even though they are deemed to be higher in terms of the voice-verified

grade of the offense, if you will, they are usually sentenced to, given the nature of Carmelo Anthony's lack of criminal history and things of that nature, a person would usually receive less of a sentence than he did. voice-verified

And so I absolutely agree with Monique that the sentencing here is high, although I don't see that as being the only factor worth consideration in this conversation. voice-verified

Don, I do want to point out for viewers in terms of, and this is a little bit in the weeds, the process that Monique was just talking about with respect to a Batson charge. voice-verified

There may be, on behalf of Carmelo Anthony's defense team, an opportunity to appeal the notion of the way that the Batson charge was decided, only because... voice-verified

What typically happens, and Monique can attest to this, when you are at trial and you are going through jury selection and you raise a challenge to a witness based off of something that you believe would preempt them from being on trial. voice-verified

you will at times have a judge or say that they should be stricken for cause. voice-verified

In a bastion challenge of this nature, the judge can have an opportunity to have a sidebar with the witness and attorneys present and ask them whether they can be fair and impartial. voice-verified

I've had this happen to me before where I have risen voice-verified

where I've made a challenge to a witness, and because of the challenge that I've made, the judge will try to rehabilitate that witness by asking them, do you have a problem with being a teacher, understanding that there are going to be students and witnesses who are connected to schools? voice-verified

the judge has either allowed and the witness will usually say, yes, I can be fair and impartial or no. voice-verified

happen in this case as a result of these Batson charges, but I do want to make clear for our viewers and for the audience that there are additional steps of recourse that the judge did have in this case when a Batson challenge is raised in order to try and rehabilitate a juror so that they can actually serve. voice-verified
