District Court Judge Mustafa Kusubi only allows ICE arrests without a warrant if there's a likelihood of an escape.

Courts in Colorado and Washington, D.C.

have issued similar rulings, and the government is appealing them.

Testimony included one plaintiff who said he was arrested and held in an ICE detention center for three weeks, even though he has a valid work permit and a pending visa application.
