What do you tell your clients, so say for example, there's a subpoena and it imposes a really tight deadline or requests a massive amount of documents, how do you advise your clients in that case?
Well, one other thing we were talking about is how healthcare organizations and providers can put themselves in the best possible position to handle subpoenas.
And you alluded to this earlier, and it's just so important that you should have policies in place.
So that would be a big lesson for us to impart today, which is you know, the policy should address the types of information that the organization maintains and ideally would designate an individual primarily responsible for intake and assessment of those subpoenas that are soliciting PHI.
only to determine whether the appropriate response is to send out one of those cover letters, Terry, that you mentioned, or to reach out to in house counsel or outside counsel.
