There should be flexibility and there should be judges should have the power in exceptional cases to say I'm not making a final order, I am building in a limited review.
And again, perhaps in those cases, the more serious cases, where there's good reason to monitor for the safety of the children whether this plan is actually going to work in reality.
We at the bar we're we're advocates and that's what we do.
We cross examine witnesses and we make submissions to judges.
And I think the shock to the system is that this approach is of course an investigative re approach.
It tries to avoid

And so I would say as advocates, we know instinctively when there are issues that you can brush under the carpet and when those issues are
central to determining where a child's best interests lie.
And our job as advocates is to identify those issues.
And that's what the practice direction twelve J says, doesn't it?
That we've got to be able to identify the issues
argue why they are relevant.
to the decisions to be made about child's welfare going forward and then push to have those
determined in the time honor tradition.
I think there are cases, I've already said this, where you can
bang people's heads together and tell them to be sensible.
And there are others where that's just a wrong and dangerous approach.
So it's picking your battles
And then fighting them as hard as you can.
