Yeah, I I'm not aware at this moment of any uh allowance to not provide parking for um units of any size under state density bonus law parking standards.

And regarding the setbacks, it's fifteen feet street side setback and then uh twenty five feet from the residential adjacent sites.

So would there be an exemption where they could go f closer to the street?

So I do not recommend making a motion to take out the properties tonight because I don't believe that council has the authority in of itself to just amend

What I think you could do is you could direct staff to take the steps necessary to work with HED, to consult with HED to see what would be required in order to amend the housing element to take those sites out.

So rather than actually just removing them yourselves, I think the direction is

For staff to work with us, and we would just reach out to H C D and explain the situation and figure out if we need to go through a full

Public process and then comment period.

Um the law talks about substantial amendments.

I don't know if this would be considered a substantial amendment and would require extensive process or if H C D would advise that it was something less.

But I think really the direction should be to explore that with H C D rather than to remove it tonight.

Under that scenario, how would that work if you were able to justify it?

Um so I think as noted earlier, right, there would be a a process staff would have to undertake um with staff work, um technical analysis, environmental review, public engagement, public review and comment, uh and coordination with the state agency uh in order to effectuate that.
