evidence that enjoys a privilege to a grand jury.
So it looks like she abused the grand jury in at least two ways, according to the magistrate judge's ruling of a few days ago.
Of course, there was today's vindictive prosecution motion.
That was the third reason to dismiss, and that was robustly argued.

And this guy Lemons is his last name.
He was not up to the task of arguing this case on behalf of the federal government, in my estimation.
And then when Judge Nachmanoff started pressing both Lemons and Lindsay Halligan on what the heck went on in the grand jury,
Because you had two indictments.
You signed them both.
They were contradictory.
And there's no indication you ever presented the second one to the grand jury as is required.
And Lemons couldn't answer.
He kept going over and whispering in Halligan's ear and Halligan would whisper back.
Finally, Judge Nachman often had had enough and said, Miss Halligan, step to the podium.
And he fleshed out the fact that this looks like it was just a horribly botched procedure.
So you've got the substantive misconduct in the grand jury.
