They don't have to prove that the farmer or the manufacturer or the restaurant acted carelessly or intended harm, or even that they knew that something was wrong with the product.
They basically just need to show that they consumed the product at issue and that they were sickened by it.
The key piece of the puzzle becomes the traceback, determining what was the source of the contamination.
One thing one lawyer told me is that he sees this litigation as really being about trust or a breach of trust, that we as ordinary consumers can't see or smell or taste this kind of product contamination.
And so you're trusting the person who serves it to you to make sure that it's safe.
And if it's not, that's why we have this mechanism to hold those involved widely responsible, even if the harm wasn't intentional.
