The director of Columbia University's Immigrants' Rights Clinic filed a petition on behalf of an 18-month-old girl known as Amalia and her parents.
They were held at an immigration detention facility in Dilley, Texas when the girl developed a respiratory infection.
After more than a week in the hospital, she and her mother were sent back to the immigration facility with a nebulizer and medication.
The lawsuit says U.S.
immigration officials confiscated the equipment and wouldn't allow the girl to use the nebulizer upon return.
A federal judge in Texas ordered their release Friday.
The girl's parents came to the U.S.
from Venezuela in 2024 and were allowed to stay with immigration check-ins
until they were taken into custody late last year.

Thursday morning, dozens of anti-ice protesters marched, chanted, and banged on drums outside the home of Hilton CEO Christopher Nassetta in Arlington, Virginia.
The organizer, Will McBride, told ARL Now, a local media outlet, that ICE terrorizes people in the middle of the night, not allowing families to sleep well, so they wanted to give the same experience to the CEO.
Demonstrators have targeted ICE at different hotels around the country in Minnesota and New York during enforcement operations.
After one Hilton location independently owned and operated,
canceled some ICE agent bookings in Minneapolis.
Hilton officials said that had been improper.
They insisted they rent to everyone.
And the Hilton label was then removed from this hotel shortly after the incident last month.
