President Trump has said that violent protests outside the Portland Ice Building left the city, quote, war ravaged and threatened the safety of federal employees.
But Judge Karen Emmerget, a Trump appointee, said in her ruling that protests had generally been peaceful since June, with fewer than 20 protesters on average.
Oregon Attorney General Dan Rayfield celebrated the decision at a press conference and called it a healthy check on the president's power.
The judge could extend a restraining order on October 17th.
