I just think it's silly, I'll be honest.
I mean, that's not a technical legal term, but it's absurd.
There's nothing in Article 2 that says anything about a pardon even being written.
It just says that the presidential have the power to grant reprieves and pardons against
for offenses against the United States, except in the case of impeachment.
And presidents do all kinds of stuff without their signatures, executive orders down through.
I mean, it's a massive executive branch apparatus.
In theory, everybody answers to the president.
And so this notion that by virtue of what kind of instrument is used to make it official, that has some constitutional implications.
And oh,
And as a practical matter, of course, it would throw into disarray not just pardons, but other decisions made by prior presidents.
It's just silly.
I mean, how this could come up, I guess, in the context of a particular pardon, say the high profile pardon of Hunter Biden, Joe Biden's son, that got a lot of criticism at the end of Joe Biden's term.
If
If Donald Trump were to direct Pam Bondi, which we're seeing, which is another conversation we can have, how disturbing it is that the Justice Department's acting at the behest of an individual to target specific people, not address crimes.
But say Pam Bondi were to prosecute Hunter Biden, Hunter Biden would move to dismiss the indictment and say, I have a pardon.
