And the court said, no, it's just way too extreme here.

It's risky.

We prefer that they don't.

Usually we get them to give evidence when there's just no other evidence of their version.

So if they give an interview to police, they partake in an interview with police and they give their version...

If that version is solid and credible and stacks up in line with all the other evidence, then I would not want my client to give evidence.

Oh no, that interview's great.

We can rely on that.

Otherwise, if there's other evidence that supports our client's version, like phone records or conversations with other people, whatever.

You know, movements like you might, for example, if there's an armed robbery at a bank and, you know, you can see the car's movements and there's alibis and things like that, then I don't need my client to give evidence.

I'd rather them stay put and assert their right to silence and just run the defence based on the weaknesses of the case and other supporting information.

Because cross-examination has got to be... Oh, nerve-wracking, unbearable.

Yeah, I feel for everyone that's subjected to that.

It's terrible.

Incredibly risky.

Cross-examination's an art.

Yeah.

And I saw a Supreme Court justice present an event recently where he said that he still does it at the dining room table just to keep his skills up, which sounds fun as a party guest.

Sounds like a nightmare, yes.
