So in most state unemployment programs, there is a provision that an overpayment can be waived if there was no fraud on the part of the claimant. voice-verified

So a state can decide in the interests of equity and good conscience, as the guidance says from the Labor Department, they can decide to waive an overpayment. voice-verified

Some do, some don't, some take advantage of that. voice-verified

Some states don't even actually have that clause, so they have less leeway to waive some of these overpayments. voice-verified
