Steele submitted paperwork with the United States District Court in the Southern District of New York on Tuesday, indicating his intent to appear as counsel for Diddy when the trial properly kicks off in just 26 days.

He's actually a very interesting attorney. Brian Steele is a seasoned criminal defense attorney, but he's, again, based in Atlanta, Georgia, which is why he actually filed a request to be able to practice in New York to join Diddy's team.

And as we mentioned earlier, he's best known for representing Young Thug in his own racketeering case, which actually was the longest in Georgia's history, I believe. What's interesting, again, about him, he's really known as being very aggressive and tough in court, and he really stands his ground. At least that's what a lot of the other attorneys who I spoke to have said.

He was even actually held in contempt in court during that trial because he refused to disclose how he learned about a private meeting between a judge, prosecutors, and a key witness in that case. So that actually was later reverted, that contempt ruling. against Steele, which was ruled by the Georgia Supreme Court. And so he was able to go on with the case.

But TMZ actually also reported that Diddy's legal team was looking to add a black attorney after Anthony Rico left the case. So it was kind of a surprise that Brian Steele's name came up.

And that hearing you mentioned there also featured Combs' lawyers suggesting that they may require a two-week adjournment for his trial if they don't receive what they described as critical evidence from prosecutors. One of Combs' attorneys, Tenny Garagos, said the defense hasn't received some 200,000 emails between Diddy and one of the alleged victims. Now, here's a question for you, Kayla.

So anyway, Assistant U.S. Attorney Chrissy Slavik said prosecutors opposed any delay and went on to accuse Combs's lawyers of using, quote, gamesmanship to delay the trial. Judge Subramanian, a man with a good turn of phrase, told the defense, saying, quote, we are on a freight train speeding towards trial.

And of course, there's more. On the same day, April 4th, Diddy's legal team filed a motion to exclude, quote, prior bad acts evidence.

What was in your reporting? Yeah, we obtained some court documents from both sides and essentially prior bad acts, that is actually a legal term that refers to evidence of past actions that's not actually directly related to the current charges that defendant has committed.

So, again, in this case, the prosecution wants to introduce evidence, which is here more than likely other witnesses who can testify about their own experiences of abuse or sexual assault with Diddy, which prosecutors say will show his character or what they say propensity. to commit the crimes that he has been charged with.

So now these witnesses are, in addition to the four named victims who are in Diddy's criminal complaint, including Cassie, as we mentioned. Normally, prior bad acts evidence are not actually admissible, but there are exceptions, especially in cases like this, in sexual assault trials, where the evidence may be allowed to prove motive or intent.

And that's what essentially both sides are arguing right now. Didi's attorneys don't want those witnesses to come forward and take the stand. And prosecutors saying, look, we need these new witnesses to come forward and to talk about a pattern of behavior that Didi has had.

Right. It'll be interesting to see whether or not they'll have another hearing just to argue in front of the judge about this. They both sides, the prosecution and the defense team have laid out their arguments. It would be up to the judge whether he actually just goes ahead again, makes the order or it will be argued in court in another hearing.

So what is interesting here is defense attorneys are saying, look, if the judge will allow all of these other prior bad act witnesses, this could lead to many trials. They would argue, you know, they shouldn't be allowed to testify because it would be too prejudicial. So this could who knows how long it'll take in terms of actually getting the trial started.

That could mean that it could push back the trial. I don't know. Now, the defense attorneys also argued, look, we can argue this for another trial even before we pick the jury. So right now, we're not quite sure where it will land. So anxiously waiting to see what the judge says.

Last Friday, Iron Man and Empire actor Terrence Howard became the first major star to speak up, alleging Diddy made a sexual advance towards him during what he described as a, quote, bizarre encounter. While appearing on the PBD podcast, 56-year-old Howard told a story about Diddy saying, quote, invited me for weeks, asking me to be his acting coach for a while.

However, when they met, Howard alleged that Diddy simply sat there staring at him to the point where it began to make him feel uncomfortable.

Yeah, truly, really. I was a bit shocked about the story. But as you mentioned, most people have turned their backs on Diddy. So now I think more and more people are going to feel more comfortable to come out there with their own experiences with him. Uptown, during your time there and also obviously Diddy's time there, you guys brought out the biggest artists. You mentioned some of the members of Jodeci. There was Father MC, Mary J. Combs' team have specified Douglas Wigdor, who represents Combs' ex Cassie Ventura, for speaking to the media. They attempted to keep the 2016 Los Angeles hallway surveillance video of Diddy pulling and dragging Cassie by the hair from being played for jurors, but the judge ruled it will remain as evidence.

Undeniably, his influence on hip hop and just the culture in general is huge. But the fact that where he is now, his fall from that, you as his personal friend, that must be really difficult. I mean, what's it been like for you seeing that?

Wigdor told DailyMail.com he plans to file a response to the gag order request, saying, "...we will vigorously oppose the motion seeking an extraordinary sweeping gag order as it is an obvious attempt at controlling and silencing victims under counsel in contravention of well-established legal and ethical precedent.

And again, it's important to say that these are just allegations against him. He's facing his trial in a week, actually. But what was your reaction when you actually saw that video of Cassie getting attacked by your friend?

The motion, filed on Sunday, April 27th, draws on testimony made by psychiatrist Dr. Eli Aoun. The details of his alleged condition have been redacted in the documents, but there are a few clues that Dr. Aoun will claim that Diddy's mental capacity was affected. Prosecutors are trying to prevent Dr. Irene's testimony and said they don't believe it's relevant.

Prosecutors said legal precedent requires a defense to give proper notice before offering any, quote, evidence of effects of drugs and alcohol on a defendant's memory or cognitive function. Another clue in the documents, prosecutors described the doctor's potential testimony as evidence of quote, the defendant's inability to control behavior.

Interestingly enough, Terry Garagos, one of the defense attorneys for Diddy, mentioned in court that they expect there to be a discussion about Kim Porter and they might be frequently bringing her up.

During a debate about one potential juror who might be allowed to serve, prosecutor Maureen Comey actually disputed that claim and said that she doesn't think that they're going to bring up Kim Porter a lot. Again, it seems like a small world and being that Diddy just knew everybody and worked with everybody in the industry, there'll be a lot more celebs names coming up in this witness list.

We want to also explain how the UK and US courts differ. In the US, juries are preselected and require a unanimous verdict, whereas UK juries are actually randomly selected and can reach majority verdicts. Also, typically in the U.S. court system, federal cases, no cameras are allowed. So what you're seeing from there are just court artists rendition of what Diddy looks like.

And it's actually been interesting because the court sketches that we're getting right now, Diddy walked in with a, quote, preppy look, according to our reporter again, Dan Bates, who's inside courtrooms. And Diddy is wearing gray pants, navy crew neck sweater, and a crisp white shirt with no tie. And he's still rocking the gray beard and hair.

Another source of mine tell me that hair dye is actually in the commissary list. So he could have actually have his hair did before court. But again, he's still rocking the gray. So we'll see. But she's also helped the defense team with other high profile cases.

In a remarkable burst of activity this week, Christina Karam, who is Diddy's former chief of staff, has given a statement to Rolling Stone reporter Cheyenne Roundtree. Diddy is now in a federal lockup since, gosh, September 16th. He has remained there for, gosh, despite several attempts to be released on bail. And now actually it looks like the May 5th court date will be pushed back by a week.

The trial looks like it's going to start now on May 12th. Now, do you anticipate that it will actually move forward on May 12th?

And just today, as you mentioned, the federal prosecutors were told to hand over the names of those three alleged victims who are, again, connected to the federal criminal indictment. And the judge's order said their identities were disclosed to Diddy's attorneys, quote, under attorney's eyes only designation. Can you explain what that means?

And now even if he does, again, we're still far away from the criminal trial. So looking at that crystal ball, what happens if it does keep moving forward? Does that delay all of his civil cases as well?

Yes, Diddy has been charged under the Mann Act, which is also known as the White Slave Traffic Act, which is a 1910 federal law prohibiting transporting people for prostitution.

Now, Diddy's lawyers have said that the law has historically been used disproportionately against Black men, citing rock and roll pioneer Chuck Berry and early 20th century's most famous boxer, Jack Johnson, who was actually known as Galveston Giant, as examples.

There's so many things still up in the air, obviously, as we move forward and possibly more cases will be filed. But were you shocked that there was a superseding indictment filed in this case?

The lawyers allege that, quote, no white person has ever been the target of a remotely similar prosecution, pointing out former New York Governor Eliot Spitzer's case where escorts were charged, but he was not. Now, Diddy claims that he's being singled out because of his race and being, quote, prosecuted for conduct that regularly goes unpunished because he is a powerful black man.

Kelly, you know, Diddy is obviously fighting for his life. He's, as you mentioned, he's also himself have gone after NBC Universal, News Nation, filing these other lawsuits. But how is it going for both sides, for both the prosecution and Diddy's team?

What a lot of people also are curious about are the potential witnesses. As you mentioned, Cassie is more than likely one of the alleged victims mentioned in the criminal suit. But, I mean, Diddy had his hands and knew everybody. A-listers, everybody you know, went to his parties.

When it comes to the Jeffrey Epstein victims, they received the money through his state because he did pass away in jail. As we mentioned on the main episode this week, a few days ago, the defense lawyers wrote to the judge claiming the prosecutors have been slow to turn over some potential evidence for review, including materials relating to a superseding indictment returned by a grand jury earlier this month. These actions have, they say, made it difficult for them to fully be ready in three weeks.

Now, Diddy's lawyers say some evidence have yet to be released to them includes materials related to a count in the indictment that carries a 15 year mandatory minimum prison sentence if a conviction is cured. In reaction, they wrote, quote, We cannot in good conscience go to trial on the scheduled date. This is a problem that the government has created, yet it opposes our reasonable requests.

As we know, prosecutors opposed the request and the judge said he would address the issue during a hearing that was scheduled for today, Friday. And now he has and the request has been denied with a judge saying jury selection for the trial will begin on May 5th as scheduled. Adding, quote, it is unclear why there isn't sufficient time to prepare.

Diddy has of today been held without bail for 213 days since his arrest last September. And he has vehemently denied every allegation made in all recent lawsuits filed against him. And he also has denied all federal charges that have been filed against him. But that wasn't all that happened today.

Diddy's attorneys also asked the judge to order former girlfriend Cassie Ventura to turn over the draft of her memoir and notes. Although she's actually not named in that motion, Diddy's attorney, Mark Agnafillo, has claimed Cassie wrote a book about him that he could, quote, catch and kill for $30 million, which is according to TMZ.

BREAKING NEWS Motion Denied (Again)
Cassie's attorneys filed a motion to block this and claimed that he even wanted her bank statements. The judge ruled that Cassie must turn over her memoir drafts by April 25th, but not her financial statements. Diddy's attorneys also filed a motion to block the now viral CNN video of Diddy attacking Cassie at an LA hotel back in 2016.

They claimed the video was edited to make Diddy look more menacing compared to the original hotel surveillance footage. They also claimed CNN destroyed that footage. CNN denying the allegations asserts that it neither altered the footage nor discarded the original, which it says remains with the source.

On Friday, the judge also denied an attempt by Warner Brothers Discovery to hold back outtakes from its Fall of Diddy docuseries from January of this year. Specifically, the footage the defense want to see involves a former employee of Combs' and an ex-girlfriend.

Warner Brothers Discovery attempted to use reporters' privilege to keep the outtakes out of the case, but the judge rejected that notion because both of the individuals in the footage seem likely to be giving testimony in the trial, and therefore the outtakes are deemed relevant and admissible. As we're recording this episode, they're actually still in court, but we do have a reporter inside.

What's striking is this letter states, quote, and fairly minded viewer of the videos will quickly conclude that the prosecution of Mr. Combs is both sexist and puritanical. It is sexist because the government's theory perpetuates stereotypes of female victimhood and lack of agency.

Now, Diddy has pleaded not guilty to all the accusations, and both he and his legal team have repeatedly and strongly asserted his innocence.

Yes. This week, Diddy's attorneys had filed another motion asking the court to force the prosecution essentially to release Marjorie. I believe it's nine videotapes having to do with the allegations with victim number one, which we all know is Cassie. And they're saying that prosecution should turn over these videos of Diddy and Cassie because they need to review the videos in its entirety.

Yeah, and Marjorie, Diddy's lawyers have pointed toward new evidence that they say, quote, makes clear the government's case is thin. And as we said earlier, there's been a very natural slowing down of claims and counterclaims in this case recently. For the past few weeks, it felt like there were new allegations coming out all the time, but recently things have slowed down.

So it'll be really interesting to see how this develops. And it's important to be clear that Diddy and his attorneys have always maintained the rapper's innocence. So they believe there was sufficient evidence that he actually interfered with the case or even tried to flee before the trial, which is now set for May 2025.

And they also talked about an alleged, quote, pattern of violence toward women and his own staff. Now, his defense attorneys also argued that he's been unconstitutionally held in jail and effectively been silenced since he was first arrested back in September.

At the height of his career, Sean Diddy Combs had it all. It seemed like everything Diddy touched turned to gold. Now the once untouchable hip-hop mogul is fighting for his life as he faces multiple federal charges in New York, including sex trafficking and allegedly running a criminal enterprise.

They went on to claim that the government had launched a campaign against Diddy to prevent him from getting a fair trial and that their client is, quote, not required to sit idly by and acquiesce to all of this.

The ruling read, the court finds that the government has shown by clear and convincing evidence that no condition or combination of conditions will reasonably assure the safety of the community. The quote, compelling evidence of Combs' propensity for violence was also said to have influenced the judge's decision.

Right. Diddy's lawyers had hit back and claimed that the prosecution's case is, quote, fictional and has had a, quote, theatrical spin on it. They have also claimed that the 2016 Cassie video was, quote, manipulated to look worse than it really is. But that's it. Diddy is not looking to get out anytime soon. And after three bail denials, it seems that it's unlikely that his lawyers will try again.

Jane Doe had claimed Diddy attempted to sexually assault her while at a party in New York in 1995. She also alleged that Diddy hit her when she refused his advances. Her attorney, Tony Busby, filed her suit back in October 2024.
