The Department of Homeland Security claims that an immigration officer killed Alex Preddy in self-defense after the 37-year-old approached with a handgun.
But witness video shows a group of agents struggling with Preddy and knocking him to the ground before one opens fire.
It's unclear from the video whether Preddy attempted to use the firearm in his possession.

The suburban Columbia Heights School District says agents detained Liam Conejo Ramos, who was five years old.
School officials say masked agents apprehended Liam in his driveway as he returned home from school with his dad.
They say one agent took the child out of the car, led him to the door, and directed him to knock to see if anybody else was home.
ICE soon took the father and child away.
DHS says they are being detained in Texas.
On social media, the Department of Homeland Security says ICE has never, quote, used a child as bait.
In the May 12th memo, which the Associated Press first reported, acting ICE director Todd Lyons claims that agents need only an administrative warrant from ICE itself to enter someone's home.
