He was engaged in all kinds of shady dealings about Native American land.

And so the opposition faction to Cosby

prevailed upon Zenger to use his newspaper to print their editorials and their critiques of him.

That's really what got him into trouble.

And so eventually Cosby ordered that Zenger be arrested for what was called seditious libel.

There you go.

That's a terrible thing to be accused of.

It is a terrible thing.

Not something you want to engage in, I guess.

Certainly not in New York in the 1730s.

But so Zenger goes to trial.

He's held in jail.

He goes to trial.

And

Cosby has his lawyers disbarred before the trial.

So even more shenanigans.

But then, very famously, Zenger's backers hired a well-known attorney from Philadelphia called Andrew Hamilton.

And Hamilton came in to the court case and he argued that

It's not liable if what you say is true.

And that was not part of the common law of England.
