Well, Jim Jordan did a criminal referral yesterday to the Justice Department on Biden's special counsel, Jack Smith.
Jack Smith, as we know, was this rogue political partisan operative, this scut missile launched by Biden to try to take out Trump.
And as part of Jack Smith's investigation of Trump and his aides and his allies, Jack Smith subpoenaed
the text messages, the content of the text messages from 44 members of Congress, including 20 senators and 24 House members, including the Speaker of the House, the number two in the House.
It's a big deal to subpoena congressional members' telephone records, their text messages.
They did it for 44 of them.
And then
Jack Smith didn't apparently have the tank teams in place, the filter teams in place to make sure they're doing a review for privilege, which is a big problem.
And then Jack Smith got asked about what he did in those investigations as part of his December 17th, 2025 deposition in front of the House Judiciary Committee.
And Jack Smith, according to Jim Jordan, the chairman's
criminal referral lied.
He provided materially false statements to Congress, to the House, because Jack Smith said that he only got the toll records of these phone calls, meaning two from phone number duration and not the content.
Well, according to this criminal referral, that is a lie.
Jack Smith lied because he did get 44%
members of Congress's text messages.
And so that's why we have this criminal referral.
When you have these criminal referrals, I've helped draft these for then-chairman Chuck Grassley, the Senate Judiciary Chairman, when I worked on the Kavanaugh confirmation and we set criminal referrals.
When you lie to congressional investigators like this, like Jack Smith is alleged to have done here, according to Jim Jordan's letter,
you could be charged with perjury because it's under sworn testimony, under his deposition, presuming it was a sworn deposition.
