So when there's a plea deal, there has to be a factual allocution.

The defendant has to say what they did.

The facts have to support the elements of the crime.

So today in court, Luigi Magioni did just that.

Is he going to use that narrative of the pain and his mindset and the healthcare system as a mitigating factor?

Why would that make a legal difference?

Well, a mitigating factor means that when you're in sentencing, there's all sorts of things that the judge takes into consideration.

And here you have a really, really serious charge where somebody

So what the defense will do is raise what's called mitigating factors, things that actually take away from what the potential sentence could be.
