And I think that's where we run afoul of, frankly, many cases that we've seen out here being prosecuted for more serious crimes of premeditation, as you mentioned, or even similar crimes with a white counterpart. voice-verified

And so I think the conversation really has to be around why this keeps happening to black boys, frankly, not men, boys, and what can be done about it. voice-verified

who made it to kind of the final phase of the jury selection process, they were struck by the prosecution. voice-verified

And the defense raised what's called a Batson challenge and put before the judge their belief that they were struck because of race. voice-verified

And the prosecution offered by way of response that they were struck for what we call neutral reasons, that they were educators, that this involved witnesses who were going to be coaches, students in a school system. voice-verified

And that I don't know if the argument was that they believed there would be a lack of partiality voice-verified

or that it would be more difficult or that they would believe or disbelieve the witnesses more or less, but it had to do with their field of education. voice-verified

The standard is one that really, if you just offer any kind of sliver of a reason other than race, it gives the judge the leeway to buy it. voice-verified

And the other thing that I raised, not just with the Batson challenge, but with this case, period, in Texas, because this wasn't a federal case, this was a state case, is every portion of this case, Don, voice-verified

to me points to the importance of our voting system and the importance of our showing up when it matters in local elections, because what I hope we will talk about him being charged as automatically as an adult at 17, voice-verified
